The Regulations define the general conditions, principles and method of sales conducted via the polskieziarno.pl online store, as well as the provision of services electronically.

  • 1. Definitions
  • Supplier - an entity commissioned by Polskie Ziarno to deliver the ordered Goods to the Customer,
  • Business Days - days from Monday to Friday, except public holidays.
  • Polskie Ziarno - for the purposes of the Regulations, "Polskie Ziarno", depending on the context, means: the brand under which the Goods are sold, or the owner of the Polskie Ziarno brand, which is the entity running the Online Store, i.e. Logistic sp. z o.o.
  • Customer – a natural person, legal person or other organizational unit capable of performing a legal transaction, purchasing the Goods.
  • Consumer - (a) a natural person concluding a legal transaction with Polskie Ziarn not directly related to its business or professional activity, including concluding a Sales Agreement, or (b) a natural person concluding with Polskie Ziarn a contract directly related to its business activity, when, from the content of this the contract shows that it does not have a professional character for her, resulting in particular from the subject of her business activity, made available on the basis of the provisions on the Central Registration and Information on Economic Activity.
  • Customer Account – an individual Customer panel, launched on his behalf by Polskie Ziarno within the Store, after the Customer has registered.
  • Basket - functionality of the Online Store in which the Goods selected by the Customer are visible, enabling the Customer to enter and modify order data, in particular: type and number of Goods, delivery address, delivery method, payment method.
  • Regulations - these Regulations with all possible annexes and annexes.
  • Store (Online) – administered by Logistic sp. z o.o. online platform enabling the purchase of Goods, under the terms set out in the Regulations, operating at the following address: https://polskieziarno.pl/.
  • Goods – a product from the commercial offer of Polskie Ziarno offered for sale via the Online Store.
  • Sales Agreement - a sales agreement concluded via the Store between Polskie Ziarno as a seller and the Customer as a buyer, the subject of which is the Goods.
  • 2. General provisions
  1. The Regulations define the rules for using the Online Store, as well as the rights and obligations of Polskie Ziarna and Customers.
  2. The condition for making purchases in the Online Store is the acceptance of the Regulations by the Customer - acceptance of the Regulations takes place before each order for the Goods. The Regulations are available at any time on the Store's website, in the Regulations tab, where you can download them free of charge, read their content and print them in any number of copies or save them on any durable storage medium.
  3. Polskie Ziarno is entitled to change the provisions of the Regulations. All orders accepted for execution before the date of entry into force of the new Regulations are carried out on the basis of the Regulations that were in force on the day the order was placed by the Customer. Customers will be immediately informed about any changes to the Regulations - to the latest e-mail address known to the Seller. The consolidated text of the current Regulations, containing all changes, is also published on the website of the Online Store.
  4. The store is typically available 24 hours a day at the following website: https://polskieziarno.pl. However, Polskie Ziarno does not guarantee continuous access to the service in the form of using the Store. Interruptions in making the Store (or some of its functionalities) available to Customers are possible, in particular due to modifications or maintenance of the Store.
  5. Contact with the Store is also possible via telephone: +48 797 761 136 on Business Days from 7:00 a.m. to 15:00 p.m. and by e-mail at the following address: przedaz@polskieziarno.pl, as well as a Facebook profile located at the website address https://www.facebook.com/polskieziarno/. Polskie Ziarno provides Customers, on Business Days from 7:00 a.m. to 15:00 p.m., with technical assistance in the operation of the Store, available through the communication channels indicated above.
  6. The cost of all types of telephone calls made by the Customer to Polskie Ziarno telephone numbers in connection with the use of the Online Store corresponds to the usual costs of calls used by the operators whose services are used by the Customer.
  • 3. Creating an account in the Online Store
  1. Registration in the Online Store (creating a Customer Account) is done independently by the future Customer.
  2. When registering, a potential Customer completes the application form available on the Store's website, providing his name and surname and e-mail address. To the e-mail address provided by the future User, Polskie Ziarno sends a return e-mail confirming the data provided during registration and containing instructions on the need to confirm registration, as well as a password with which the Customer can log in to the Store (the password can be changed independently by the Customer after logging in). After confirming the registration, Polskie Ziarno creates a customer account.
  3. The customer has access to his data in the "My account" tab.
  • 4. Concluding Sales Agreements
  1. Purchases via the Online Store can be made by both registered and unregistered Customers.
  2. The Customer placing an order in the Online Store completes the order by selecting the Goods and adding them to the Cart using the "Buy Now" button available on the Store's subpage presenting the given Goods.
  3. After completing the order and indicating the delivery method and payment method in the Cart, the Customer places the order by sending the order form to Polskie Ziarno, selecting the "Buy and pay" button. The placed order results in the conclusion of a Sales Agreement between the Customer and Polskie Ziarno, which in particular results in the obligation to deliver the Goods by Polskie Ziarno and the obligation to pay for the Goods by the Customer.
  4. Polskie Ziarno immediately confirms the receipt of the order by sending an automatically generated e-mail to the address provided by the Customer containing: order number and date, details of the parties, description of the Goods (including possibly its code assigned by Polskie Ziarno), total sales price, method and the date of payment and the method, place and cost of delivery. The Regulations of the Online Store are attached to the message.
  5. Communication between Polski Ziarn and the Customer is conducted in Polish. The Sales Agreement is concluded only in Polish.
  6. The content of the concluded sales contract is recorded and made available to the Customer by making the Regulations available and sending the Customer the e-mail referred to in section 5 above.
  • 5. Payment of the price
  1. The prices of the Goods shown in the Online Store are gross prices and include VAT. The prices do not include delivery costs or other costs that the Customer may be obliged to incur in connection with the Sales Agreement for Polskie Ziarna. In each case, the Customer will be informed about these possible other costs before placing the order.
  2. Payment for the purchased Goods may be made in the form of prepayment or payment on delivery - at the Customer's discretion. Payment in the form of prepayment may be made by bank transfer via an online payment operator or by bank transfer by the Customer to the Polskie Ziarno bank account number: 97 1020 5138 0000 9402 0261 6175.
  3. If the Customer has chosen the form of prepayment, he or she should make the payment in the amount specified in the concluded Sales Agreement within 3 days of placing the order. If the Customer fails to pay within this period, the Seller may withdraw from the Sales Agreement without setting an additional deadline.
  4. The customer agrees to receive VAT invoices in electronic form - as PDF files - to the e-mail address indicated in the placed order.
  • 6. Deliveries
  1. Deliveries are made only within Poland.
  2. The ordered Goods are delivered to the Customer via the Supplier to the address indicated in the order form.
  3. Information about available delivery methods and the costs of delivery of the Goods will be provided to the Customer each time before placing an order. It is also available in the FAQ tab on the Store's website: https://polskieziarno.pl/faq/.
  4. Information on the number of Business Days needed to complete the order is posted in the Online Store, and if there is no such information regarding a given Good, orders will be processed within 2 Business Days.
  5. The goods are delivered on Business Days.
  6. The general terms and conditions of delivery of the Goods specified in the Regulations and the FAQ tab may vary depending on the type of the Goods, their quantity or weight. In such a case, detailed delivery conditions are provided in the description of the Goods, in the order form or agreed individually with the Customer.
  7. The customer should check the condition of the shipment before accepting it. It is recommended that in the event of damage or other violations of the shipment, the Customer requests the carrier, pursuant to Art. 74 section 1 of the Transport Law, protocol determination of the condition of the shipment and the circumstances of the damage. In such a case, the Customer may refuse to accept the shipment, and Polskie Ziarno is entitled to pursue claims from the carrier.
  8. If, after the shipment has been delivered, damage or other violation of the shipment is discovered that cannot be seen from the outside upon receipt, the carrier determines the condition of the shipment at the Customer's request reported immediately after the damage is discovered, but no later than within 7 days from the date of receipt of the shipment. In such a case, the Customer is entitled to pursue claims from the carrier.
  • 7. The right to withdraw from the contract
  1. The Customer who is a Consumer may withdraw from the Sales Agreement, without giving a reason, within 14 days from the date of receipt of the purchased Goods, subject to the cases described in section 2 and 3 below. To meet the deadline, it is enough to send a declaration of will to withdraw before its expiry.
  2. The right to withdraw from the Sales Agreement is not available in the cases specified in Art. 38 of the Act of 30 May 2014 on consumer rights, including:
    1. non-prefabricated items, manufactured according to the consumer's specifications or serving to meet his individual needs,
    2. items that deteriorate quickly or have a short shelf life,
    3. items delivered in a sealed package for health protection or hygiene reasons (the item is not returnable if the package has been opened),
    4. items that, after delivery, due to their nature, become inseparably combined with other items.
  3. A declaration of withdrawal from the sales contract may be submitted:
    1. electronically to the address sklep@polskieziarno.pl,
    2. in writing to the address Polskie Ziarno,
    3. on the form, the template of which is an Annex to the Regulations, but using the form is not necessary. The form template can be downloaded here.
  4. Returned Goods should be sent back immediately, no later than within 14 days from the date of withdrawal from the sales contract, to the address of Polskie Ziarno, i.e. Budzów 53, 57-215 Srebrna Góra.
  5. The costs of returning the Goods are borne by the Customer.
  6. When returning the Goods, the Customer should pack them in a way that protects them against damage during transport and use a transport service appropriate to the type of Goods.
  7. The Customer is liable for any reduction in the value of the returned Goods resulting from using them in a manner that goes beyond what is necessary to establish the nature, characteristics and functioning of these Goods.
  8. Polskie Ziarno will refund all payments made to the Customer, including the cost of delivery of the purchased Goods to the Customer, no later than within 14 days from the date of receipt of the declaration of withdrawal from the sales contract. Polskie Ziarno may withhold the refund until it receives back the Goods concerned by the withdrawal or until the Customer provides proof of returning the Goods.
  9. If the Consumer exercising the right of withdrawal (return) has chosen a different method of delivering the Goods than the cheapest regular delivery method offered by Polskie Ziarno, Polskie Ziarno is not obliged to reimburse the Consumer for any additional costs incurred as a result.
  10. If, due to their nature, the returned Goods cannot be sent back by regular mail, Polskie Ziarno will inform the Consumer about the costs of returning these items in the Online Store.
  11. Polskie Ziarno refunds the payment using the same method of payment as used by the Customer, unless the Customer has expressly agreed to a different method of return, which does not involve any costs for him.
  • 8. Complaints
  1. Polskie Ziarno is obliged to deliver Goods without defects and is liable to the Customer if the Goods have a physical or legal defect. A physical defect consists in the non-compliance of the Goods with the Sales Agreement. A legal defect occurs when the Goods are the property of a third party or if they are encumbered with the rights of a third party, and if the limitation in the use or disposal of the Goods results from a decision or judgment of a competent authority.
  2. The loss of properties of the Goods due to the passage of time cannot be claimed as a defect if the defect occurred after the expiry date and the loss of properties resulting from storing the Goods contrary to the manufacturer's instructions or accepted customs regarding the Goods of a given type.
  3. The complaint may be sent to the address of the Polskie Ziarno headquarters or in electronic form to the following e-mail address: sklep@polskieziarno.pl.
  4. When filing a complaint, please provide the type of defect and the date it was discovered, as well as indicate the warranty rights that the Customer wants to exercise.
  5. The place to which the Customer should deliver the defective Goods in exercise of the Customer's warranty rights is the registered office of Polskie Ziarno, i.e. Budzów 53, 57-215 Srebrna Góra.
  6. The cost of returning the Goods by the Consumer, in accordance with section 5 above is borne by Polskie Ziarno. In the case of other costs (damages) incurred by the Customer in connection with the complaint, the Customer may demand their reimbursement on general principles arising from civil law.
  7. Complaints will be considered within 14 days from the date of notification by the Customer.
  8. If the purchased Goods have a defect, the Customer may:
    1. submit a declaration of price reduction (in the same proportion to the sales price as the value of the Goods with a defect remains to the value of the Goods without the defect) or - in the case of a significant defect - of withdrawal from the sales contract (return the purchased Goods), unless Polskie Ziarno immediately and without excessive inconvenience to the Customer, it will replace the defective Goods with a defect-free one or remove the defect; this limitation does not apply if the Goods have already been replaced or repaired by Polskie Ziarno or Polskie Ziarno does not replace the Goods with a defect-free one or does not remove these defects,
    2. if he is a Consumer - instead of what is described in point a) above the removal of the defect - demand replacement of the Goods with a defect-free one or instead of replacing the Goods, demand removal of the defect, unless bringing the item into compliance with the contract in the manner chosen by the Consumer is impossible or would require excessive costs compared to the method proposed by the Seller,
    3. demand replacement of the defective Goods with defect-free ones or removal of the defect; However, Polskie Ziarno may refuse to comply with the request if achieving compliance with the sales contract in the manner chosen by the Customer is impossible or would require excessive costs compared to the other possible method of achieving compliance with the contract.
  9. Polskie Ziarno is liable under the warranty if a physical defect is found within two years from the date of delivery of the Goods to the Customer.
  10. If the complaint is deemed justified, Polskie Ziarno is obliged to immediately satisfy the Customer's request formulated in the complaint, taking into account Polskie Ziarno's right to obtain a return transfer of ownership and possession of the Goods subject to the complaint in the event of a request for replacement or withdrawal from the contract. If the Customer is entitled to request a refund of the price of the Goods in whole or in part - the refund will be made within 14 days from the date of delivery of the Goods complained about to Polskie Ziarna.
  11. The sales price is refunded using the same payment methods that were used by the Customer when concluding the Sales Agreement, unless the Customer indicated a different method of refund.
  12. Goods sold by Polskie Ziarno may be covered by a warranty granted by the Goods manufacturer or distributor. In the case of Goods covered by a warranty, information regarding the existence and content of the warranty is always presented in the Online Store.
  • 9. Extrajudicial methods of dealing with complaints and pursuing claims

The Seller does not use extrajudicial forms of dispute resolution.

  • 10. Provision of services electronically
  1. Polskie Ziarno provides customers, electronically, with the following free services related to the Online Store:
    1. Customer Account,
    2. Remembering your shopping cart.
  2. The contract for the provision of electronic services is concluded when you start using such a service and accept the terms of the Regulations.
  3. In order to create a Customer Account, you must register. The service of maintaining a Customer Account consists in providing the Customer with an individual panel enabling modification of the data provided during registration, tracking the status of orders and viewing the history of orders already completed. Registration is not necessary to use the Online Store.
  4. The Customer may register by completing the registration form available in the Online Store and sending the completed registration form electronically to Polskie Ziarna by selecting the appropriate function in the registration form. The first login password to the Customer Account is sent to the Customer by Polskie Ziarno via e-mail to the e-mail address provided by the Customer during registration. The Customer can then modify the password via the Account. The login to the account is the Customer's e-mail address provided during registration.
  5. The Customer may delete his/her Customer Account at any time - using the functionality available in the Customer Account.
  6. The Cart Remembering Service means that the Goods entered by the Customer into the Cart will be kept in the Customer's Cart until they are deleted by the Customer or the cookies of the web browser used by the Customer are cleared, identifying the Goods entered by a given Customer into the Cart.
  7. Customers are prohibited from posting illegal content on the Online Store's website and using its content or functionality for any unlawful purpose.
  8. The Customer may submit a complaint to the Seller in connection with the use of free services provided electronically - the complaint may be submitted electronically to the following address: przedaz@polskieziarno.pl. The complaint should include a description of the problem. The complaint will be considered within 14 days.

11 Technical conditions for using the website

  1. Polskie Ziarno makes every effort to ensure that the use of the Online Store is possible for Internet users using all popular web browsers, operating systems, types of devices and types of Internet connections. The minimum technical requirements to use the Online Store are:
  • operating system Windows 7, Windows 8, Windows 8.1, Windows 10 or newer,
  • Intel Pentium 4 or newer processor supporting SSE3
  • Internet browser in the current version: Mozilla Firefox; Internet Explorer; Opera; Google Chrome; Safari or Microsoft Edge

 

  1. In order to use the Online Store, including to place an order, the Customer must have an active e-mail account.
  2. The public nature of the Internet and the use of services provided electronically may involve the risk of obtaining and modifying Customer data by unauthorized persons. Polskie Ziarno informs about the following specific potential threats related to the use of services provided electronically:
    1. receiving spam, i.e. unsolicited commercial information sent electronically,
    2. infection of the IT system by malicious software (worms, viruses, Trojan horses, spyware, wabbits, etc.),
    3. security breaches aimed at obtaining confidential information or password fishing (phishing) for the purpose of identity theft, e.g. by sending fake electronic messages resembling authentic messages.
  3. In order to protect against threats related to the use of services provided electronically, it is recommended to:
    1. installation of antivirus software,
    2. updating all software,
    3. not opening e-mail attachments of unknown origin,
    4. reading application installation windows and their licenses,
    5. regular comprehensive system scans with antivirus and antimalware software,
    6. when paying electronically, ensuring that data transmission is encrypted (banking mode),
    7. using an original system and applications from a legal source.

12. Final provisions

  1. All rights, including copyrights and intellectual property rights to the Online Store and its elements, such as graphics, text (except for texts posted by Customers), trademarks or other markings appearing on the Store's website, are the property of Polskie Ziarno , unless otherwise stated. It is prohibited, among other things, to use them in any other way not directly related to the use of the Store.
  2. The administrator of personal data processed in connection with the operation of the Online Store and the website polskieziarno.pl is Logistic sp. z o.o. Detailed information on the processing of personal data can be found in Privacy and Cookie Policy
  3. Polish law applies to Sales Agreements.
  4. All disputes arising in connection with the conclusion and performance of Sales Agreements will be resolved by a common court of general jurisdiction, and in the case of a Customer who is not a Consumer - by a common court competent for the registered office of Polskie Ziarna.
